Trademark Application Packages

KLF Legal offers flat-fee packages for federal trademark applications filed with the United States Patent and Trademark Office. Kenan L. Farrell, a USPTO-registered attorney, prepares and files each application. The fee is set before the firm is retained. A free initial telephone consultation is available if you are not sure which package fits.

Each package covers one class of goods or services. A class is the USPTO category for what you sell. “Clothing” and “restaurant services” are different classes. If you need more than one class, the flat fee increases by $350 per additional class. That amount is the current USPTO filing fee for the extra class.

What is included in every package

  • Attorney review of the mark against formal USPTO requirements before filing

  • Preparation and filing of a federal application for one class

  • USPTO government filing fee for that class

  • A copy of the filing and the serial number

If the mark does not meet formal requirements, the firm will help you select a mark that does, or refund the package fee.

These packages cover preparation and filing. They do not include a response to a later USPTO office action, an opposition or cancellation, a statement of use, a renewal, or enforcement against another party. Those are quoted separately after the letter or the facts are reviewed.

U.S. Trademark Application - $1,000

Use this package if you have already searched the mark, or if you are filing a mark you already use and you want the application filed without a separate clearance search.

Includes everything in “What is included in every package.” No clearance search is performed under this package.

U.S. Trademark Application and Preliminary Clearance Search - $1,750

Includes everything in the $1,000 package, plus an attorney search of the USPTO database for obvious and readily identifiable conflicts.

This is a knockout search. It is meant to catch clear problems in the federal register before you spend the filing fee. It does not search state trademarks, business-name records, or common-law use. It does not guarantee that the USPTO will register the mark, and it does not mean no one else is using a similar name.

Choose this package if you want a fast check for an obvious federal conflict and you are ready to file if none appears.

U.S. Trademark Application and Full Search - $2,250

Includes everything in the $1,000 package, plus a full U.S. trademark search: USPTO records, state trademark records, business-name databases, and common-law sources. The search is a Thomson CompuMark U.S. Full Search, reviewed by the attorney.

This is the package to use when the brand is a real investment and you want to know, before filing, whether use of the mark is likely to collide with someone else’s rights. A full search still cannot guarantee registration. It gives a much clearer picture than a USPTO-only search.

If you decide not to file after the full search, $950 of the package fee is refunded.

Which package to choose

  • You already know the landscape, or the mark is already in use and you want it filed: $1,000.

  • You want an attorney to check the USPTO for an obvious conflict before filing: $1,750.

  • The name is central to the business and you want the broader search before you commit: $2,250.

If you are unsure, start with the free consultation. Do not pay for a full search on a mark you are not prepared to abandon.

After the application is filed

Filing is not registration. An examining attorney reviews the application. Many applications receive an office action. Responding to that letter is a separate engagement. See Office Action Responses.

An intent-to-use application still requires a statement of use, or an amendment to allege use, before it can register. Those USPTO filings, and any related attorney work, are not part of these packages.

For a plain explanation of whether federal registration is worth it, see Should You Register Your Trademark?.

Additional classes and other fees

The prices above are for one class. Each additional class adds $350, which is the USPTO filing fee for that class.

Other USPTO fees can arise and are not included: a fee for an identification of goods or services that is not taken from the USPTO ID Manual, a fee for insufficient information, an extension of time, a statement of use, or a petition. Those are government fees. The firm will tell you before any of them is incurred.

Foreign applications

Foreign trademark applications are quoted separately. Price depends on the country, the number of classes, and whether the filing is made directly or through the Madrid Protocol. Contact the firm to discuss.

How to start

Send the proposed mark, the goods or services, and whether you are already selling. The first conversation is a free telephone consultation. The package fee is confirmed before the firm is retained.
