Statement of Use Filings

We would be pleased to assist with your Statement of Use filings.

A Statement of Use is a statement indicating that you are using your trademark in interstate commerce. The Statement of Use must list: (a) the date of first use anywhere; (b) the date of first use in interstate commerce; and (c) include a representative example, a.k.a. a specimen, (in each class) showing the trademark as used in commerce. A Certificate of Registration will be issued shortly after the Statement of Use is accepted.

Note that you have six months from the mailing date of a Notice of Allowance to file a Statement of Use.

 

If use of the trademark in commerce will not commence by the six month deadline, it is possible to file a Request for an Extension of Time to file a Statement of Use. The extension request will give you an additional six (6) months to show use of the trademark in commerce. An applicant is allowed to file up to five (5) Requests for Extensions of Time to file a Statement of Use.

 

Keep in mind that this is an absolute deadline for submitting either a Statement of Use or a Request for an Extension of Time to file a Statement of Use. If no Statement of Use or Request for an Extension of Time to file a Statement of Use is filed by the deadline, the application will be abandoned.
